its a very simple question as to who registered the trademark first, did joey de leon registered it? no! it was Tape Inc who registered it. whether or not joey de leon is an employee, it was Tape Inc that registered it

Abraham-Garduque said the decision should be scrutinized as this would have a negative effect not only in the entertainment industry but in others as well.

“We humbly believe that this decision deserved a second look in an appeal because otherwise if we follow it, any person/talent in a show who, for example, would suggest for a name of a segment of a show, will be the owner of said title and when he is not a talent anymore the producer cannot use that segment anymore,” she said.

She added, “This holds true to other industries. Like, for example, a person who dreamt of having a resto and first thought of McDonald’s but cannot afford to have one so he did not ever have a resto named McDonald’s can now file a cancellation of the trademark for McDonald’s food chains because based on the decision, he is considered as the originator of that trademark?”

yeah i know. same thing lang sa tvj alam ng lahat ng taong bayan na tvj talaga nag simula ang EB kahit nasa tv5 pa sila nag simula noon hnd pa nila producer ang tape. ang prob lang kasi ung mismong ahensya na ung nag desisyon. kung kaya naman patunayan talagang papanig sayo kahit korte pa. lets see kung anong final desicion sa court of appeals at SC kung aabot pa man ng SC yan

naiintindihan ko din kung bakit gusto rin ng tape ung trademark na EB kasi branding yan eh may pera jan.

see mataas rating kasi sa brand na EAT bulaga. kaya d ko rin sila masisi kahit hnd sila creator ng EB i cocontest nila yan kasi may malaking pera na involve jan.

He he. Clickbait ang mga ibang balita kaya hindi kumpleto ang pagkaintindi ng mga tao sa "specifics" ng trademark issues na pinanigan ng IPOPHL for TVJ. Ang malinaw pa lang sa nga ngayon, ang pinanalo ng TVJ (which is rightfully theirs) is Class 16, 18, 21, 25 doon sa approved registration ng TAPE na nilabas from this news. Yung EB song is TVJ property, including the products they provide using that name.

Yung Eat Bulaga trademark classes na pinanalo ng TVJ is more on "products".
Ang pinagtatalunan nila ngayon ay yung trademark for "services" na Class 41 (refers to the use of entertainer services, entertainment services, production of shows, production of radio and television programs, television entertainment, providing online videos not downloadable, providing television programs via video-on-demand services, presentation of live performances and presentation of variety shows).

Since ang blocktime ng GMA-7 is up to the end of 2024, we'll see who justifies to use EAT BULAGA on the tv shows after this period after IPOPHL releases their statement on who owns the "this" class of trademark. Medyo nasa downside ang TAPE dahil nahuli sa plea at naunahan sila ni Joey De Leon na mag-apply for registration ng CLass 41 trademark sa same name/class on time after it expired this year. JDL is one of the co-founders of Eat Bulaga franchise, together with the rest of the trio, Antonio Tuviera and Romeo Jalosjos Sr.
Pagdating sa ganitong scenario, yung katibayan sa korte at legalities ng facts ng dokumentong kailangan ang masusunod ayon sa mata ng batas. Whoever has the edge in court wins. Talagang ganyan.
