Is the Philippine government indeed lawyering for China?


The incident is only part of the stream of a grander issue: the Philippines' rights over Recto Bank.
Duterte himself downplays the Philippines' exclusive rights to fish in the area.

This is despite a 2016 international ruling that recognizes Recto Bank as part of the Philippines' exclusive economic zone, a 200-nautical mile area where the Philippines has the exclusive rights to fish and enjoy other resources, such as oil and natural gas.

Experts say the Recto Bank incident could only be a test of the Duterte government's reaction to China’s similar moves in the future. If the government reacts lightly, this could further embolden China to ram more Filipino boats to drive them away from the West Philippine Sea.

Ako ay di naman dismaya sa pangkalahatang gawain ng ating gobyerno, pero dyan sa Recto Bank issue bosing, agree ako sa'yo sa maling pagtrato ng ating gobyerno para sa kapakanan ng mga biktimang mangingisda. Ito nga ay isa lamang "maritime accident" (totoo naman), pero ang salarin ay isang dayuhan (Intsik) na sa batas ay di dapat nandoon - kahit pa sabihin nila na kanila yon. Iba nang usapan yan. Ang importante, dapat marinig ng taumbayan yung simpatiya sa ating kababayan na napinsala at matatag na paninindigan sa ating "sovereign rights" doon. Kahit pa patuloy na "dispute" yan ng dalawa, at mga karatig na bansa ukol sa SCS, hindi maiaalis ang nararamdaman ng taumbayan sa takbo ng mga pangyayaring kaugnay dito.

Alam din yan ng mga Amerikano noon pa man simula ng inalis na ng Japan ang kanilang pag-aari dyan sa pinagtatalunang mga islands sa SCS after WWII. Wala lang sa kasulatan yung transfer ng pag-aari kaya pinagpatuloy nila "silently" hanggang umunlad na yung kanilang bansa at tumatag na yung "military at navy prowess". Nagkaroon tuloy sila ng malayang paghahari sa karagatang yan kahit pa sangkatutak na hinaing ang ipasa sa UN/ASEAN atbp. ahensya ng mga bansang sangkot dito - na wala namang kaukulang hakbang na nagawa yung mga kinauukulan kundi sa papel din. May problema rin ang UNCLOS at mga nakadikit dyang courts - they can't enforce force in China but only thru writing. Kaya, taon at pera na yung naubos, nanalo tayo sa korte, pero kung walang "consent" pala yung other party ay pwede palang tanggihan lang ng ganun-ganoon. Anong silbi nila. Ang maaring mangyari, ay kakapit ka sa patalim ng mga manggagamit, gamitan ng pwersa ang kalaban/magsugal ng buhay o kaya ay gamitan ng diplomasya. Kung alin mang hakbang ang susundin ng gobyerno, kasama tayo dyan, sa ayaw at gusto natin. Just be prepared. But it's a sad truth that international laws can be overrun by a superpower. Parehas lang tayo ng kaso ng Nicaragua, di ba?

Ang "PROC at ROC" ang may hawak ng Spratlys, Paracel Islands, Scarborough Shoal, atbp. (andoon na sila ngayon) kaya sinabing sila ang may kapangyarihan sa SCS. Pero ang Tsina rin ay di maikakaila na pressured dahil patuloy ang pakikipaglaban ng Pilipinas,Vietnam atbp. sa international courts. Sa ganyang pagkakataon, anything could happen dahil di lang tayo ang may interes sa SCS. Ang Kano ang isa nilang balakid na ginagamit yung Freedom of Navigation (FON) at military exercises/counter-intelligence sa dagat at sa himpapawid.

Bilateral/diplomatic (settlement) talks ang paraan ni Duterte sa ngayon kaya siguro maingat siya sa pananalita. Hindi maganda sa ekonomiya kung palaban na hakbang ang kanyang gagamitin. Lalamunin niya ang pride niya as a sacrifice for national stability. Yan lang sa ngayon ang magiging pansamantalang sagot sa krisis habang naghahanap ng ibang solusyon. Maging ang Vietnam ay nagsisimula na rin maging malumanay at maingat sa pakikitungo sa Tsina para umimpis yung tensyon nilang dalawa. Pagod na rin sila sa marami nilang "stand-offs/clashes" noon mga nakaraan. Sa pagkaalam ko, may balak silang buuin ang Code of Conduct for South China Sea (COC), similar doon sa nasirang ASEAN- China Declaration of Code of Conduct (DOC) 2002 na di naman nasunod dahil sa mga pasaway at inuuna lagi yung pansariling interes. Sa ASEAN agreement yan na ang mamumuno ay Vietnam by year 2020. Mabuti ng meron kaysa wala eka ngang mga Vietcongs, kaya let's just wait and see. Baka magkasundo na silang lahat. At sana, huwag pangunahan at sirain ng media ang isip ng mamamayan sa walang katuturang mga balita.

You don't see the real problem which is that duterte is giving up our sovereign rights to the benefit of china... in less than 20 years from now, if nobody stop him or his dynasty, the Filipinos will be slaves of china...
